In connection with the purchase and sale of a used car, the transaction should always be documented in writing in the form of a final note.

What is a final note?

A final note is another word for a purchase agreement used in the purchase and sale of used vehicles. However, please note that this final note only applies to the purchase and sale of used cars – not other vehicles.

The final note is a written contract between the seller and the buyer that describes all the essential terms of the trade. It includes a description of the car, the selling price and when the car is to be transferred from seller to buyer. 

In addition, the final note determines the buyer and seller’s responsibilities and obligations in connection with the sale of the car – it includes, among other things, registration of the new owner in the Motor Register. Both the buyer and the seller may choose to have certain reservations or special rights, such as the buyer being allowed to have the car tested by a third party, e.g. FDM.

Why should I make a final note when buying and selling a used car?

In principle, agreements do not need to be written to be valid – this also applies to the sale of used cars. However, it is so that an oral agreement can be very difficult to prove. The parties often forget to deal with significant terms of agreement, which may give rise to later disagreement and uncertainty regarding the terms of the sale of the car.

Therefore, we always recommend that you make a written purchase agreement. Legal Desk’s final note allows the buyer and seller to agree on a number of important matters, which are otherwise typically lost by oral agreements. It includes:

  • a description of the condition of the car so that no doubt can arise later.

  • the buyer is given the opportunity to buy the car with the proviso that the car’s condition is approved by a third party, such as FDM.

  • a provision as to whether various accessories are included in the trade, such as winter tires.

  • a provision as to who is responsible for the re-registration in the Motor Register after the sale of the car.

  • that the final note can be used as an accounting document if the seller and / or buyer has to account for his or her personal finances or business.

The final banknote can be used by persons residing in Denmark and applies to all used cars registered in Denmark.

How do I make the final note valid?

Once you have completed our form, you will receive your final note immediately. After that, it must be dated and signed by the buyer and seller, which you can easily and safely do with each of your NemID or MitID. 

Once the final note is signed, it is valid. Thus, there is no requirement for registration, knowledge-based witnesses or legal assistance. However, as you have written, remember to register the change of ownership in the Motor Register.
