Marriage is an agreement between spouses

If you, as spouses ( or future spouses ), want some form of quirky in marriage, you must formally enter into the agreement in one marriage. The marriage covenant must be registered to become valid. So it is not enough that you just sign the agreement.

If one of you does not speak or understand Danish, we recommend that you also make an English translation of the marriage covenant, as otherwise there may be a risk that the marriage covenant will be violated as invalid. By making an English translation you ensure that you can both understand what is being agreed upon.

Which country’s law applies when the spouse is a foreigner?

When entering into a marriage contract with a foreigner, it is very important that you make it clear whether Danish law applies to your wealth at all. If you have both been permanently resident in Denmark within the past five years, there is no problem and Danish law applies without further ado.

If only one of you who has Danish citizenship or permanent residence in Denmark and the other of you is foreign, you can actively choose to be Danish law, that should apply to your marriage. Just make sure you announce this when you make a marriage contract. Read more about marriage with a foreigner, if you have any doubts about which country’s law applies to your particular marriage.

This marriage can therefore only be used if you are subject to Danish law in relation to your wealth.

 

How to make a marriage covenant

Once you have received your marriage covenant, it must be registered to obtain validity. So it is not enough that you just sign the document. The registration costs DKK 1,850 in public tax. Whether you let us fix the registration, or you do it yourself, you both have to sign the marriage covenant with NemID/MitID in order for the registration to be final.

 

If one of you does not have a Danish CPR number

If one of you does not have a Danish CPR number and thus not a NemID or MitID, you can make a registration proxy. In short, a registration power means that you allow another person with NemID or MitID to sign the marriage contract digitally on behalf of the spouse without a Danish CPR number.
