Gift Letter

If you want to give a great gift whose value exceeds what you normally give for Christmas or birthdays, we recommend making a gift letter. It documents the size of the gift and the terms of the gift transfer, such as who is to pay the tax. How the gift letter is created and any gift tax paid, you can read about it here.

What is a Gift Letter?

A gift certificate is written documentation that one person has given another person a greater gift. The gift letter describes any terms associated with receiving the gift. In the gift letter, for example, you can decide that the gift must be peculiar to the recipient and therefore should not be shared with his or her spouse if they are to be divorced at a later date.

The gift letter also agrees who should be responsible for notifying the gift and paying any gift tax to SKAT.

Can I use a gift voucher for money gifts?

DKkonsult gift certificate can be used regardless of whether the gift is a gift in the form of cash or other assets, such as jewlery or stocks.

This means that you can use the gift letter if, for example, you have to give larger money gifts in connection with wedding, confirmation and the like. Many people typically use a gift letter when giving money to children.

However, the DKkonsult gift letter cannot be used if you want to provide real estate.

Benefits of making a gift letter

A written gift letter is an advantage for both giver and recipient:

• The gift letter serves as documentation ( proof ) that the given is actually a gift and thus is neither a loan nor a sale for payment

• The gift letter determines the terms of the gift, including who is to pay any gift tax

• The gift letter allows gift giver to decide that the gift must be the recipient’s special ownership, and therefore should not be shared with his or her spouse

Gifts between spouses

Spouses are free to give each other greater gifts without being taxed or subject to gift tax. Previously, spouses had to make a so-called gift marriage, if the recipient should not risk the donor demanding the gift back in the event of, for example, a divorce. Gift marriage covenants are no longer used, as the rule that spouses may demand gifts back is abolished.

However, we still recommend that you make a gift letter if you want to give your spouse a larger gift, as you have written documentation on, among other things, that it is a gift and not a loan.

Special Own

As mentioned above, you can set the terms for the transfer of the gift with the gift letter. In the gift letter, the giver has the opportunity to decide that the gift should be made into special ( complete or combination special ). This means that the gift will remain the property of the recipient, regardless of whether they are divorced later.
